IADL STATEMENT ON THE ARREST AND TORTURE OF M.BARGHOUTI

The International Association of Democratic Lawyers (IADL) an organization in consultative status with the ECOSOC, and represented at UNESCO and UNICEF
and with affiliates in over 96 countries, strongly condemns the methods applied by Israel and its General Security Service against Palestinian prisoners and detainees, in particular, Marwan Barghouti, an elected member of the Palestinian Legislative Council whose parliamentary immunity should be protected.

IADL urges Israel to comply with the provisions of the Fourth Geneva Convention relative to the Protection of Civilian Persons in Time of War  (1949). Contravening article 49 of the Convention, Marwan Barghouti was transferred from Ramallah, which is located in the Occupied Palestinian Territories, to a detention center at the Russian Compound in West
Jerusalem. During his interrogation Barghouti suffered from ill-treatment with cruel, inhuman and degrading treatment (violation of articles 31-32, 146-147).

Israel is a signatory to the key human rights covenants that address torture and ill-treatment, the International Covenant on Civil and Political Rights (article 7) and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. Israel is therefore legally bound by these prohibitions.

Israeli law prohibits torture and the introduction into evidence of tainted confessions and provides that public servants who use or direct the use of force against persons for the purpose of extorting a confession of an offense or information relating to an offense are liable to imprisonment.

IADL considers  that the  arbitrary arrests of Palestinian people by Israeli forces constitute grave infringements  according the international law.

IADL demands that all Palestinians under administrative detention, including Marwan  Barghouti, should have the right to a fair trial, access to legal counsel and knowledge of charges and their attorneys should be able to review the evidence against them.

The State of Israel must be held accountable for these violations under the norms and  conventions of international law and must be sanctioned.

It urges that the State of Israel recognizes the respect for universally international norms, and particularly those that guarantee the right and the respect of all prisoners and detainees.

It is essential that the State of Israel stops violating of international law and commiting  grave threats immediately. We urge lawyers around the world to act now and fast.

DECLARACIÓN DE LA ASOCIACIÓN INTERNACIONAL DE JURISTAS DEMOCRATAS SOBRE EL ARRESTO Y TORTURA DE MARWAN BARGHOUTI

La Asociación Internacional de Juristas Demócratas (AIJD),  organización con estatuto consultivo ante el ECOSOC, y con representación en la UNESCO y UNICEF y afiliados en mas de 96 países, condena fuertemente  los métodos aplicados por Israel y su Servicio de Seguridad General a los prisioneros y detenidos Palestinos, en particular, a Marwan Barghouti, miembro electo del Consejo  Legislativo Palestino cuya inmunidad parlamentaria debería ser protegida.

La AIJD exhorta a Israel a cumplir con las normas del Cuarto Convenio de Ginebra relativo a la Protección Debida a Personas Civiles en  Tiempo de Guerra (1949). Contraviniendo el artículo 49 del Convenio.  Marwan Barghouti fue transferido de Ramallah, que está situada en los  Territorios Palestinos  Ocupados, a un centro de detención en el  Recinto Ruso en Jerusalén Occidental. Durante su interrogatorio  Barghouti sufrió maltratos con tratamientos crueles, inhumanos y  degradantes (en violación de los artículos 31-32, 146-147).

Israel es estado signatario de los tratados fundamentales de derechos humanos que se aplican a la tortura y los maltratos, el Pacto Internacional de Derechos Civiles y Políticos (artículo 7) y la  Convención contra la Tortura y Otros Tratos o Penas Crueles,  Inhumanos o Degradantes. Por ello, Israel está legalmente obligado por estas prohibiciones.

Las leyes Israelíes prohíben la tortura y la introducción como evidencia de confesiones obtenidas ilegalmente y establece que los  funcionarios públicos que utilicen o dirijan la utilización de la  fuerza contra las personas con el propósito de extraer una confesión de un delito o información relacionada con un delito, son pasibles de prisión.

La AIJD considera que los arrestos arbitrarios de palestinos realizados por las fuerzas  Israelíes constituyen graves violaciones de acuerdo al Derecho Internacional.

 La AIJD exige que todos los Palestinos bajo detención administrativa, incluyendo Marwan Barghouti, tengan el derecho a un juicio justo, acceso a asesoramiento y conocimiento de las imputaciones se les han  realizado, y sus abogados deben poder rever la evidencia que existe contra ellos.

 El Estado de Israel debe ser considerado responsable de estas violaciones a las normas y convenciones del derecho internacional y debe ser sancionado.

Exhorta a que el Estado de Israel reconozca el respeto por las normas universalmente internacionales, y particularmente aquellas que garantizan el derecho y el respeto de todos los prisioneros y detenidos.

 Es fundamental que el Estado de Israel cese de cometer graves amenazas y de violar el derecho internacional inmediatamente.

Exhortamos a los abogados del mundo a que actúen ahora y lo hagan rápidamente.
